Hello and welcome! These Terms of Service are an agreement formed between you and Familia, Inc. They cover the website available at Familia.AI (the "Website"), and the Familia.AI mobile application (the "App"). In these Terms we'll sometimes refer to Familia, Inc. as "Familia.AI," "Company," "we," or "us." We'll refer to our Website and App, together with any content, tools, features and functionality offered on or through them, as the "Services."

These Terms govern your access to and use of the Services. Please read them carefully, as they include important information about your legal rights. By accessing or using the Services, you're agreeing to these Terms. If you don't understand or agree to these Terms, please don't use the Services.

Use of the Services

Your Registration Obligations: When you register to use the Services, you agree to provide accurate and complete information about yourself. If you are under 13 years old OR if you are an EU citizen or resident under 16 years old, do not sign up for the Services – you are not authorized to use them.

Member Account, Password and Security: You are responsible for maintaining the confidentiality of your password and account, and for all activities that occur under your password or account. You agree to immediately notify Familia.AI of any unauthorized use of your password or account or any other breach of security.

Account Deletion and Data Removal: You may request deletion of your account and all associated data at any time by contacting us at [email protected]. Upon such request, we will initiate the deletion process. Please note that full deletion of all personal data, media, and associated metadata from all servers and backups may take up to 90 days.

Intellectual Property Rights

Content You Submit: When you submit Content to the Services, you represent and warrant that you own all necessary rights. You grant Familia.AI a nonexclusive, worldwide, royalty-free, sublicensable, perpetual license to use the Content for purposes of operating, improving, or promoting the Services.

Family Characters & Generations: When you create an automated AI character ("Character") using the Services in accordance with these Terms, then as between you and Familia.AI, you own all rights in that Character. As between you and Familia.AI, you also own any text, images, audio, or video the Character generates ("Generations") that are elicited by you.

Legal Terms

Disclaimer of Warranty: Your use of the Services is at your sole risk. The Services are provided "as is" and "as available." Familia.AI disclaims all warranties, including merchantability and fitness for a particular purpose.

Limitation of Liability: Familia.AI is not liable for any indirect or consequential damages arising from your use of the Services. Total liability will not exceed $100 or the amount you paid to use the Services.

Dispute Resolution: All disputes will be resolved through binding arbitration. You waive your rights to trial by jury and class action. Arbitration will follow JAMS rules.
